TERMS OF SERVICE FOR HONESTY  
LAST UPDATED: FEBRUARY 3, 2025  

1. PARTIES  
This Agreement is between you ("User") and Aiden Ritchie, an individual residing in Newark, Delaware ("Operator," "we," or "us"). The Operator operates the Honesty mobile application ("App") independently, with no affiliated business entity.  

2. ACCEPTANCE  
By accessing the App via any distribution platform (e.g., Apple App Store, Google Play) or by the online version, you agree to these Terms. If you disagree, discontinue use immediately.  

3. ELIGIBILITY  
- Minimum Age: 13 years old (or older if required by Delaware law).  
- Prohibited Jurisdictions: Void where restricted by law.  

4. ACCOUNT REGISTRATION  
- Third-Party Logins:  
  * TikTok: By logging in via TikTok, you grant us access to your TikTok username, user ID, and public profile per TikTok’s API terms. We do not receive or store your TikTok email, password, or payment information.  
  * Expo Go: The App is built using Expo Go (React Native framework). Expo’s terms (https://expo.dev/terms) apply to technical dependencies.  
- Account Security: You are solely responsible for activity under your account.  

5. USER RESPONSIBILITIES  
- Prohibited Conduct (Delaware Code Title 11, § 1261-1269):  
  * Posting illegal, abusive, or harassing content.  
  * Impersonating others or infringing intellectual property.  
  * Reverse-engineering the App or Expo Go framework.  
  * Violating Delaware’s Computer Security Act (Title 11, § 931-939).  
- User-Generated Content:  
  * Prompts, votes, and comments must comply with Delaware defamation laws (Title 10, Chapter 39).  
  * You grant the Operator a non-exclusive, royalty-free license to store and display your content within the App.  

6. INTELLECTUAL PROPERTY  
- Ownership: All App code, design, and branding are owned by Aiden Christopher Ritchie. Expo Go and React Native are third-party tools under their respective licenses.  
- Copyright Claims: Submit DMCA notices to aidenritchiecontact@gmail.com per 17 U.S.C. § 512.  

7. DISCLAIMERS  
- "AS IS" Basis: The App is provided without warranties under Delaware law (Title 6, § 2-316). We disclaim liability for:  
  * Accuracy of AI-generated prompts (Gemini API).  
  * Third-party services (TikTok, Expo Go, Google Cloud).  
  * Device compatibility or data loss.  
- No Guarantee: We do not promise uninterrupted, secure, or error-free service.  

8. LIMITATION OF LIABILITY  
Under Delaware law (Title 6, § 2-719), the Operator’s total liability shall not exceed $10.00 USD. We are not liable for:  
- Indirect, punitive, or consequential damages.  
- Issues arising from Expo Go, React Native, or third-party integrations.  

9. TERMINATION  
- By You: Delete your account via App settings.  
- By Us: We may suspend accounts violating Delaware law or these Terms without notice.  

10. GOVERNING LAW  
This Agreement is governed by Delaware law. Legal actions must be filed in the Superior Court of New Castle County, Newark, Delaware.  

11. DISPUTE RESOLUTION  
- Mandatory Arbitration: Disputes shall be resolved via binding arbitration under the Delaware Rapid Arbitration Act (Title 10, Chapter 58).  
- Class Action Waiver: Claims must proceed individually, not as class actions.  

12. CHANGES TO TERMS  
Updates will be posted in the App. Continued use after 30 days constitutes acceptance.

14. MISCELLANEOUS  
- Severability: If any clause is invalid, the rest remain enforceable.  
- Force Majeure: We are not liable for delays caused by events beyond our control.
